INTRODUCTION

CYAN is an online platform ("platforms") owned and operated by Mimas International a company incorporated in the State of Kuwait that aims to be a hub for all activities and information related to Sea, this includes Renting yachts and boats or equipment, buying merchandise or equipment.  
These are our general terms of service that govern the relationship between our platforms ("CYAN" "Company", "we", "us") and any person who accesses our Website or/and Mobile application ("the User", "Traveler", "You") whether a registered and non-registered users.
("Website") means a set of related web pages located under www.get-cyan.com domain name, created by the Company as a digital platform. 
("Mobile Application") means a specialized software program to be downloaded by the User, created by the Company. 
By accessing the Platform, Website or/and Mobile Application, You agree that you have read, and understood, the Privacy Policy set out hereto, and that you are legally bound by them. If You do not agree with the Privacy Policy, then You are expressly prohibited from using the Website or/and Mobile Application and must discontinue use immediately. 

DEFINITIONS

"Boat" - a vessel for travelling over water, for the purposes of this Agreement, Boat shall be referred to any vessel including Yachts
" Offer" - means priced services provided to Users by Vendors
"Vendor" - Companies or individuals with offers of Experience's on the Platform

USE OF WEBSITE OR/AND MOBILE APPLICATION 

The Services on Website or/and Mobile Application are available to persons over the age of 18. The Services are also not available to any users previously removed by us or to any persons barred from receiving them under the applicable laws in any jurisdiction.
BY DOWNLOADING, INSTALLING, OR OTHERWISE USING THE SERVICES, YOU REPRESENT THAT YOU ARE AT LEAST 18 YEARS OF AGE AND THAT YOU HAVE NOT BEEN PREVIOUSLY REMOVED FROM AND ARE NOT PROHIBITED FROM RECEIVING THE YAZY SERVICES.

This Privacy Policy applies to our Website and Mobile Application Users, Traveler, and other people who may visit our Website and Mobile Application.

WHAT INFORMATION WE COLLECT?

We collect your information when you are registering an account on our Website as follows:
1. Name, mobile/phone number, ID number, email addresses and so on.
2. We store only very limited, if any, financial information that we collect. Such as IBAN or account number, which is necessary for conducting business as set out in the Terms of Service.
We may retain transactional information as long as is necessary to fulfill the purposes specified in this Privacy Policy and for recordkeeping, subject to statutory or regulatory retention requirements and legitimate business needs, such as for order tracking and status retrieval purposes. Otherwise, all financial information is stored by our payment processor, upayments, and we encourage you to review their respective privacy policies and contact them directly for responses to any questions you may have.

CHILDREN'S INFORMATION

The Website and Mobile Application is not intended for persons under eighteen (18) years of age. We do not knowingly collect personal information from persons under eighteen (18) years of age. If we discover that a person under the age of eighteen (18) has provided us with personal data, we will delete the child's personal data unless a parent or guardian provides verifiable consent to us.

CROSS-BORDER DATA TRANSFERS

The Company's principal place of business is in the State of Kuwait. If you are visiting the Website from outside of the State of Kuwait, your information will be transferred to, stored, and processed in the State of Kuwait where our servers are located and we are based. We may use and disclose personal information to affiliates, software engineers, application development providers, under contract who provide Website and Mobile Application development and maintenance that requires the provision of information collected, to accommodate the full operation of the Website and Mobile Application. We limit the information provided only to those that are material to the functionality of their services. Our contracts with them require them to maintain the confidentiality of such information.
Your information may also be subjected to disclosure in the event of defending the rights and property of the Company, its affiliates, and/or service partners under any circumstance whatsoever. THIRD PARTY PAYMENT PROCESSOR

CYAN uses a third party payment processor at checkout: UPAYMENTS  to process payments made to us via the Website and Mobile Application.  

RETENTION OF INFORMATION

We retain information collected from the Website and Mobile Application only for our records, for so long as is necessary to the operation of the Company, and/or required by applicable law/regulation. You agree to these terms to remain valid after the termination of our contract with you.

SECURITY OF DATA 

The security of your data is important to us, and we strive to use commercially acceptable means to protect information collected via our Website and Mobile Application to help ensure that the information you provide to us is protected against loss, misuse, alteration, destruction, or unauthorized access. When you visit our Website, we log your IP address (the unique address which identifies your computer on the internet). We use IP addresses to collect broad geographic information on our Website visitors and to optimize our Website. We do not link IP addresses to personally identifiable information.

JURISDICTION

This Privacy Policy of the Website and Mobile Application will be governed by and construed in accordance with the laws of the State of Kuwait.

DISPUTE RESOLUTION 

Any dispute or claim relating in any way to User's  use of the Website shall be resolved first by internal negotiations. If User  have any dispute or claim whatsoever, please contact us info@get-cyan.com

In the case that the disputes are not resolved through negotiations within one (1) month, they shall be resolved by the courts of the State of Kuwait.
